Terms and Conditions
These terms and conditions regulate the legal relationship between Speed-Net and the customers who use the services of Speed-Net to complete.
The contract for the use of Speed-Net services and activities will be implemented by submitting the online form and is effective immediately. If incorrect information appears in the order, the customer is liable for any related damages, penalties, or fines. In addition, Speed-Net reserves the right to refuse an order without giving reasons.
Duration and Termination
The contract period is specified by the customer with the first order under the given selection. After this, the subscription or the contract is automatically extended by the same amount of time and the same type of product initially ordered by the customer at the initially offered terms as long as there is no cancellation by one of the parties within 30 (thirty) days of the contract period. Regardless of the contract period, the customer generally has no right to a refund (in advance) of an amount paid.
Supply and Prices
Only the published prices by the Speed-Net are valid. Speed-Net reserves the right to adjust prices at any time without notice to changing circumstances, particularly as a result of cost increases (e.g. the price of products and material costs, currency fluctuations, etc.). Speed-Net reserves the right to modify an offer at any time without any notice. Such changes will, if not stated otherwise, become effective immediately. The customer is solely responsible to inform themselves about such changes. For existing subscriptions such changes become effective in extensions where applicable.
Terms of Payment
New accounts are set up on receiving an invoice payable within 10 days. Speed-Net reserves the right in the event of non-payment of the prior order to take legal action against the customer for the amount owned. Speed-Net will send a reminder after the actual payment date as well as prior to deactivation of the account. The deactivation will take place 7 (seven) days after the payment reminder if Speed-Net does not receive payment. Speed-Net is as a matter of principal empowered to delete accounts, including content, after the due date. If the customer defaults on a payment more than 14 (fourteen) days in arrears, then there will be a payment reminder fee of CHF 30.00
For existing accounts, a general payment period is 10 days. They are generally billed a month before the contract expires. In case of a delay in payment there will be a reminder sent by e-mail. If the payment is received by the end of the contract period, then the account can be locked immediately. For the possibility of reactivation, Speed-Net can demand a fee of at least CHF 50.00
The complete deletion of a subscription will take place provided that no payment has been received, confirmed, by Speed-Net, or if the contract is not brought back into the original conventionally state, 10 (ten) days after the blockage of an account. After a cancellation, the customer can reopen a subscription at a cost of CHF 50.00
Benefits of Speed-Net
Speed-Net ensures that all services included in the offer (in accordance with the offer descriptions on the websites of Speed-Net) can be taken during the total remission of contract time. Speed-Net can always change the scope of its services, if certain plans and options that affect server staff or make commercial quality improvements are available.
Obligations of the Customer
The customer shall ensure that the services and products, for which they (or anyone else on their account) have signed an agreement with Speed-Net, will be used legally according to the contract as well as the law. The product web hosting is provided for personal use. The vast majority of managed domains must therefore also be in possession of the customer. Special provisions apply to the content of their websites. Speed-Net prohibits racist, sexist, right infringement, and sales infringing content. In regards to pornography, also known as adult sites and banner ads or links to such content, cannot be excluded. All mentioned violations (infringing content) are in regard to the laws according to Swiss and international law.
Furthermore, this prohibits spamming, trolling, mail bombing, download archives, large extent driven mailing lists, the storage of game emulators or ROMs, IRC bots and other programs or activities, which are an excessive strain on system resources in the opinion of Speed-Net.
Violations of prohibited content can be sanctioned and can change without notice with immediate cancellation of the account and can result in deletion of all data. The customer is liable for any damages associated with the violation, including penalties and/or fines.
To secure the benefits of a user’s account, the customer is responsible for stored data. When data is lost, the customer is obligated to make backup copies for their own use. Although Speed-Net creates regular backups, the use of these can neither be requested nor guaranteed. If Speed-Net recovers lost data, there may be a reasonable handling charge. Also, Speed-Net cannot be prosecuted for deleting data.
Domain Name Reservation
Speed-Net will carry out a request for a desired domain name after the signing of a contract to SWITCH or to the respective registrar for COM / NET / ORG / BIZ and INFO domains. Speed-Net cannot guarantee the authority to actually allocate the desired domain name requested by the customer at registration. If a requested domain name is already assigned, the customer can choose a different domain name. After successful domain registration, a change to the domain name is no longer possible. The customer does not have the right to the “money back” guarantee to every ordered domain name from Speed-Net. For domain loss due to technical or other reasons, Speed-Net can not be held liable. Speed-Net assumes no liability for the loss of a domain due to the lack of, incorrect billing completion, and/or consequent non-payment. For all domain names registered by Speed-Net, the customer will be registered as the owner and therefore can always switch to another provider.
Responsibility and Liability
Speed-Net assumes no responsibility for the data and actions that benefit the customer further by his account, via means of publication or operation. The responsibility lies solely with the customer. If the customer passes his account or any part thereof to third parties, for or without payment, they also automatically become liable for this.
Speed-Net strives to inform the customers about planned maintenance or other planned service interruptions in advance to the best of their knowledge. However, Speed-Net cannot be prosecuted for business interruptions, especially but not exclusively due to maintenance, troubleshooting, or so-called events of force majeure, etc.. Speed-Net declines any liability related to damages, penalties, fines, claims for damages, lost profits or contracts and other receivables.
Collected customer data, both processed and used, is kept strictly confidential in accordance with the provisions of Swiss data protection law. The customer data will be used only within Speed-Net and shall not be shared with third parties.
On the other hand, the customer is obligated to the truthful disclosure of its data (name and legal form, name, address, phone, email, etc.) as well as to disclose any changes to this data to Speed-Net directly and voluntarily. An absolutely necessary transmission of data through Speed-Net is only relevant in connection with contracts (such as domain registration, certificate issuing, etc.) or in the event the authorities request such information.
The customer is obliged to notify Speed-Net (by email or snail-mail) pertaining to the change of an address in order to prevent difficulties in potential contact.
Speed-Net reserves the right to review these arrangements periodically and adjust as necessary without prior notice. The customer will inform his or herself at regular intervals regarding a possible changes to these terms. In case of ambiguity and/or disputes between the proprietor and the administrative contact Speed-Net is not required to resolve any disputes or to mediate the relationship between the proprietor and the administrative contact. Potentially required costs of legal services for Speed-Net will either become a cost of the protesting party or at the expense of the proprietor.
